Specific service plans, rates, availability, and eligibility are subject to individual assessment and a separate written Residency Agreement with the applicable community. Such agreement is in addition to, and do not replace, these Terms. To the extent there is a conflict between the Residency Agreement and these Terms, the Residency Agreement shall apply.

Vineyard Park Senior Living participates in Medicaid programs and may participate in other third-party payor and insurance programs. Participation in a payor program does not guarantee coverage for any particular individual, service, or length of stay. Coverage, benefit eligibility, authorization requirements, and out-of-pocket obligations are determined by the applicable payor and the individual’s specific plan, coverage period, and clinical circumstances — not by the content of this Site.
Nothing on this Site constitutes a determination of coverage, a guarantee of benefits, a representation of cost, or legal, financial, or insurance advice. AS A CONDITION OF USE OF THIS SERVICE, YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS, VINEYARD PARK SENIOR LIVING AND ITS SUPPLIERS, EACH OF THEIR PARENT AND AFFILIATED COMPANIES, AND EACH OF THEIR RESPECTIVE PARTNERS, SUPPLIERS, LICENSORS, OFFICERS, DIRECTORS, SHAREHOLDERS, MEMBERS, EMPLOYEES, REPRESENTATIVES, CONTRACTORS AND AGENTS, FROM ANY AND ALL CLAIMS (INCLUDING, BUT NOT LIMITED TO, CLAIMS FOR PREMISES LIABILITY, DEFAMATION, TRADE DISPARAGEMENT, PRIVACY AND INTELLECTUAL PROPERTY INFRINGEMENT) AND DAMAGES (INCLUDING ATTORNEYS’ FEES AND COURT COSTS) ARISING FROM OR RELATING TO ANY ALLEGATION REGARDING: (A) YOUR USE OF OUR SERVICE; (B) VINEYARD PARK SENIOR LIVING’S USE OF ANY CONTENT OR INFORMATION YOU PROVIDE, AS LONG AS OUR USE IS NOT INCONSISTENT WITH THIS AGREEMENT; AND, (C) ANY VIOLATION OF THESE TERMS OF SERVICE BY YOU. IF YOU ARE DISSATISFIED WITH ANY VINEYARD PARK SENIOR LIVING MATERIAL, OR WITH ANY OF VINEYARD PARK SENIOR LIVING TERMS AND CONDITIONS, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING OUR SERVICE.
16. MODIFICATIONS TO THE SITE AND THESE TERMS
Vineyard Park Senior Living reserves the right, in its sole discretion, to modify, suspend, or discontinue the Site or any portion thereof at any time without notice. We also reserve the right to modify these Terms at any time by posting the revised Terms on the Site and updating the “Last Updated” date above. Your continued use of the Site after any such changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, please discontinue use of the Site.
17. GOVERNING LAW AND VENUE
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law principles. Any dispute arising out of or related to these Terms or your use of the Site that is not resolved informally pursuant to Section 18 below shall be subject to the exclusive jurisdiction of the U.S. District Court for the Western District of Washington or King County, Washington, and you hereby consent to the personal jurisdiction of such courts.
18. DISPUTE RESOLUTION (CLASS ACTION WAIVER AND JURY TRIAL WAIVER)
Before initiating any formal legal proceeding, we encourage you to contact us at info@vineyardparkseniorliving.com with a written description of your concern and your proposed resolution. We will attempt to resolve disputes informally and in good faith. If a dispute is not resolved informally within 30 days of written notice, either party may pursue resolution through the courts identified in Section 17 above.
- We each hereby acknowledge and agree that, to the fullest extent permitted by applicable law, (a) EACH OF US MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY and not as a plaintiff or class member in any purported class, collective, consolidated, private attorney general or representative proceeding, (b) you will not be a member of any putative or actual class in a class action brought by anyone else, nor will either of us seek to become a class representative in an action against each other, (c) disputes regarding the enforceability, revocability, or validity of this Class Action Waiver (defined below) may be resolved only by a civil court of competent jurisdiction, and (d) nothing in this paragraph limits either your or our right to participate in a class-wide settlement. Together, the terms in this paragraph will be called and operate as the “Class Action Waiver.”
- YOU AND WE EACH HEREBY WAIVE THE RIGHT TO A JURY TRIAL TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
- TO THE EXTENT PERMISSIBLE UNDER APPLICABLE LAW, NO ACTION, REGARDLESS OF FORM, ARISING OUT OF THESE TERMS OR OUT OF THE SERVICES AND/OR THE PRODUCTS MAY BE BROUGHT BY YOU MORE THAN ONE (1) YEAR AFTER THE EVENT WHICH GAVE RISE TO THE CAUSE OF ACTION.
19. SEVERABILITY
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions of these Terms shall continue in full force and effect.
20. ENTIRE AGREEMENT
These Terms, together with the Privacy Policy and any other legal notices posted on the Site, constitute the entire agreement between you and Vineyard Park Senior Living with respect to your use of the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Site.
